Loan taken out in my name without my knowledge

Hi,
I have a loan in my name that my ex has taken out whilst we were together. I found out about it once we seperated.
I have asked the bank for a copy of the credit agreement, which at present they can't find, and I do not have any paperwork.
Talking to my ex he said that the bank told him to take the paperwork home and get me to sign for it when he applied.
Questions
If the bank can't find the paperwork, is the loan enforcable?
Have I been misold this loan, bearing in mind, I had no knowledge of this loan.
Any help gratefully recieved

    Sounds a bit suspicious to me. Banks just don't allow a random to come into the bank and apply for a loan in someone elses name, it just doesn't happen, sorry. The only possible way he could have got the bank into allowing him to bring paperwork home for you to sign, is if the agreement was a joint one. Are you sure you are telling us the full story?

    Has your ex defaulted on the payments?

    If he has, or does in the future, surely you should be looking to him as the guilty party if he has committed fraud by taking a loan in your name.

    I am not sure why you think a bank should be responsible for his criminal act. :confused:

    So essentially, you did know about the loan, you don't want to pay it any more, and this seems like a good way out of it?

    I'm afraid people cannot answer those questions until you answer a couple more.

    Did you *actually* sign it? If you signed it but didn't ask what it was for then you are not only liable for it but legally it will be very hard to do anything about it with regards to your ex.

    If you didn't actually sign it, and it was e.g. forged then you should go to the police. The bank cannot come against you for this, it's not your responsibility.

    if it was taken out without your knowledge then your ex has essentially committed fraud and is a matter for the police im afraid
    contact the police asap
