Going bankrupt & car is in partners name!

Hi,

I have finally decided to go bankrupt as I have no other option really!

My partner's father bought us a car in March this year. It was first registered in my name as my partner had points on his licence. He was also due to move in with me at the same time, but family problems on my side delayed this. He finally moved in with me in June, but we never changed the car into his name until July when we realised his points could be removed. We then had problems with the Child Tax Credits, we had to make a new claim when he did move in, but never received any tax credits from June until end of August, so I got behind on all my debts which are all in my name - most of which I stopped paying in August. As the car is now in my partners name from July, but has my name on the log book as previous owner will this be considered an asset by the OR?

Any advice is much needed :o)

    If your father bought the car and has the proof ( bill of sale) then the car is his no matter who's name is on the log book. I am sure someone will back me up on that?

    The car was bought privately, so the only thing he has is a piece of paper from the guy who sold him the car stating the date of sale, the price the car was sold for & his signature

    That is a receipt. Did he pay with cash and does his bank account show the transaction?

  • Yes, he did pay with cash, so the account would probably show the withdrawal :o)

    That's good but all that matters is the bill of sale (receipt), your dads name plus the amount, date, how much and from whom purchased.:beer:

  • It's my partners father who bought the car, it has everything on it apart from the fact there are only signatures from both (seller & purchaser) not full names printed :o(

    A signature will do even better:j After all most if not all legal documentation requires a signature or two. I should know as I signed a few to many:p
