Had BR hearing this morning

Just to keep everyone updated:

I attended court this morning and got OK'd for the £150 reduction which was good news. Just when I thought everything else was going to be straightforward the clerk got to the page which stated I had been in an IVA. The IVA failed in March 2009 and he needed to see proof of this before I could be declared BR.

Sooo I signed the forms and handed over the fees then had to rush back home to pick up the letter I was sent about my IVA. When I finally got back to the court they asked me to go and wait for the Judge which should just take a couple of minutes.

When I eventually got to see the judge she was sat in front of my file looking quite confused which really worried me!

She advised me that the problem with my situation is that I have been in an IVA; apparently they should have been informed of when my bankruptcy hearing was and given a chance to speak if they wanted to.

The judge said there was nothing she could do and even though it is clear I can't pay my debts she would have to adjourn it till 2 weeks time. :mad:

I’m surprised at the way it’s been dealt with to be honest; surely I’m not the only person to have a failed IVA who has been made bankrupt?! I just think they could have given me a heads up when doing the forms or something (like a paragraph in the IVA section), or maybe I am being unreasonable, I don’t know!

Anyway got to go back on 10th November which should give them time to write to Payplan.

I was hoping to apply for another bank account this week so I can get all my direct debits and things sorted out but they did make it clear that I am kind of floating in the in between stages so I’m guessing it wouldn’t be a good idea?

Does everyone agree with me on the bank account? I was going to go with the Co-Op (Unless it took them 2 weeks to open it, that might work!)

    Sorry about your situation, hope everything works out for you. As for the Coop Cashminder, I opened one a few weeks ago but did it over the phone, and even though I was accepted there and then it took a couple of weeks for everything to go through.

    Nightmare. Your emotions mut have gone right through the spectrum today-for it to run with no hiccups is harrowing enough.

    Ring Co-Op if you haven't already, I opened my account over the phone- I'm doubtful you will have your DDs set up together with the account up and running but you won't lose anything by having a crack at it.


    Hang in there, I hope you get it resolved.
