hi me again folks.
well ge money were supposed to be going to court on 9th october in regard to gaining an order to repossess property.
I have never heard a word and am thinking they haven't showed at court. if they have how long does it take to notify myself. I move into my rental property on wednesday.
I have contacted northern rock on several occassions to surrender the property still waiting on the paperwork last phoned them 5 weeks ago.
what the best thing for me to do, wait for ge money going for repossession or just writing a letter to northern rock surrendering the property.
any ideas would be great or if anyone has been down the same route. t

Hi I have court date on 29th with ge money. Nr will only accept a voluntary surrender of the property if you sign a form that says you remain liable for the shortfall (if there is one) on the mortgage after your br. I was told not to sign anything they sent me by my debt advisor and the lady who did my or interview, not that I was intending to sign it anyway!!0

thanks, there wont be any shortfall to nr but there will be to ge money .. although i still wasnt going to sign, am just not sure what best to do.
Tori is your court date with ge for repossession of property... would you be kind enough to let me know what happens as i dont believe ge money has actually attended the court for repossession order as i have not heard anything.0 -
Sure, I am speaking to solicitor in morning anyway as ge money have started trying to call me again! Court date is Thursday so will pm you and let you know what occurs!0

thanks tori that would be great. ge money phone me everyday from 8am to 9pm but i have blocked their number lol. although i am still told when they have called.0

I just wanted to add about being careful that there will be no shortfall. We were thinking that there will be no shortfall on our house but there just might be now with all the charges that they're hitting the account. You have no control over how much they put 'your' house on the market for either. I just don't want you to think that you're in the clear and maybe take the risk in signing NR's flaming form0

Hi broke31, have spoken to ge solicitors and told them I would not be attending court. They said all I will get after court date is a letter telling me about the repossession order, but I am not sure how long that would take to come through. Ge money themselves then rang too see if I was in a position to make a payment!!! They said that they will then be in touch with nr, and see what their plans with house are. There is apparently a 28 day posession order put on the house with an eviction date when locks will be changed and you will no longer have acess. They may decide I have abandoned the house which could speed things up a bit0

Hi,
If you aremoving to rented property soon then I would simply do nothing at all regarding the house. It is in your interests for the property to be in the possession of the lender asap so you will no longer be responsible for c/tax after the 6 month empty property rule has passed.
Once you go BR then any shortfall will go in to your BR even if the house isnt sold until after your discharge. NEVER sign anything from your lender.
