Tax Refund to me or OR?

I became BR in May 08 (i had loads of support from you guys so thank you), i received ED in nov 08, Aug 09 got a release from trustee letter.
I was notified on Friday (Oct 23rd 09) that i am due a rebate of £1350 for my self assessment for last year (08/09) which includes my expenses.

I originally had to complete a p87 then they said no it needed to be a Self assessment form, it has taken 8 months to get to where i am now.

As i change dmy job just after br, the Nil tax code stopped and went to emergency tax. I am taxed at 40% and have been since my BR.

As i am discharged almost 1 year and release of trustee done and just notified this week of rebate which is POST BR, does the OR still take it? As far as i was aware everything with my BR had completed a long time ago.

The tax office actually do not know, they just said that they wouldnt refund me until they had found out what to do.

As its my expenses, i believe it should come to me, especially as the whole BR thing has been concluded.

I never had an IPA.

Any help would be fantastic.

    Rebates for the tax year in which you were made BR can be claimed by the OR.

    The fact that you are discharged does not change that. You should have filled in a TNIDIS form for the OR/HMRC when you went BR.

    TNIDIS that you would have signed reads as.....
    To:

    The Commissioners of Inland Revenue and Department of Work and Pensions.

    I authorise and request you to provide to the Official Receiver (and to any agent appointed by the Official Receiver or any trustee who may be appointed in my bankruptcy) for all the tax years up to and including that in which I am discharged from bankruptcy:

    1. copies of my tax returns and any accounts submitted to you;

    2. details of;
    a) my tax assessments;
    b) my national insurance contributions and tax credits;
    c) any benefits I have claimed; and
    3. any other information about my tax or national insurance affairs, tax credits or benefits which the Official Receiver (or trustee) may require.

    I also authorise and request you to pay to the Official Receiver (or any trustee who may be appointed in my bankruptcy) any income tax refunds due to me for all tax years up to and including that in which the bankruptcy order was made against me.

    I recently stopped work and they have overpaid a huge amount of holiday pay which I was taxed £170. If they hadnt paid it I think i was going to get a rebate according to something personnel said earlier in month (nil tax code not applied yet) Work will be asking for holiday pay back...ie paid 1300...due £150? Will ask for £1150.....will any tax refund now go to OR as in theory I will be penalised for works error if it does.
  • Thanks Fermi, will tehy reopen my file and case to allow for this money to be be received by the OR and who will they pay with it as all of the affairs have been concluded.

    I definitely have not signed a TNIDIS form, I dont know if it was becuase I was unemployed when i went BR?

    I have a copy of every letter and form completed and signed and definitely not one of the TNIDIS forms.

    When should I have filled this in?

    As this is for my refund of my expenses for travel for my current job is this allowed? It really frustrates me as this is for my job and feel unfair that i am paying to go to work and the privieldge of soing my job.

    Should i contact the OR and get her view on it?
