Giving in notice at work - How best to do it at Christmas?

Hello All,
A slightly confusing predicament I have, I hope someone can advise me.
I am planning on quitting my job so that I don't have to return after the Christmas/New Year break. I am contractually required to give 1 months notice. I plan on giving more as I know what my plans are (moving abroad in January).:j
I have 30 days paid holiday from June 2009-June 2010. I have used 12 days so far.
At Christmas our office closes from Christmas Eve afternoon through until the 2nd of January (or the next working day after new year's day). During which time the company make you take 3 days out of your personal holiday allowance and you get 3 bank holidays - Christmas Day, Boxing Day and NY Day.
If I give notice that I am quitting on 24th Decemeber is this better that saying my last day is the 31st of December? Can you say your last day is the 31st of December even though the office is closed? I don't know what is the best option here.
If I quit on 24th Dec I will have accrued more holiday days by then, but I won't get the 3 BHs paid for and I will have another 3 days taken off my allowance - which is the best bet? :think:

June - Dec is 7 months, and 7/12 of the 30 days is 17.5
If you have had 12 days leave, plus the 3 and 3 for the Christmas Period then that takes you to 18.
You need to give notice on the 2nd December for your last day to be 2nd Jan.
They may take that remaining half-day out of your final pay packet.0 -
Don't give more notice that you are legally required to.
Your employer doesn't have to keep you employed beyond the one month's notice. In this scenario, they may well decide not to in order to save on paying you the 3 BH.
If you only give 1 month and they don't pay out the bank holidays to you, you can complain that they have terminated your employment early without the required notice. If you give them more than a month's notice, you can't do this.
In your notice state your final day of employment rather than mentioning the final day you will actually be in the office.
Realise that your employer may be a little annoyed at you for making them pay out 3 bank holidays to you. Don't let this concern you though as you have 'earned' these by working the rest of the year.0 -
Safesound - I have the normal 25 days the company provide, then I 'bought' 5 days. BHs are additional to the 30 days. So in total I have 30 days + BHs.
Zazen - yes I will have accrued 17.5 days by December and taken just 12 of those days - so the company should owe me the difference. Because the office closes over the Christmas/NY period, they make you use 3 days out of your allowance to cover that period - as no one comes in. But also during that time you get the 3 BHs as usual.
On the one hand I get 3 BHs paid during Christmas, but at the same time I have to use 3 days holiday - guess it doesn't make much difference then? I should hand in notice for finishing xmas eve.
Just read Savvys reply - I agree the employer might be a bit miffed at having to pay out for 3 BHs right at the end of the year. I thought it was a bit cheeky too. That's why I now think finishing on Xmas eve will be good - I will still get 5.5 days owed to me. I don't think they'd want to boot me out any earlier - just thought It'd be a courtesy to them to give a little extra notice.0 -
Just give one month's notice and let the days resolve themselves; if it doesn't include BHs then you will either get the option if taking the days prior to leaving or be paid the extra.
Don't confuse the 2 issues; and don't hand your notice in on 24th November or you'll lose out.0 -

Not quite.
Think of it this way:
Your final pay will either include 3 days holiday paid out because you have left or 3 days holiday paid as taken plus 3 bank holidays.
Either way you will be paid out your holidays either as leave owed or leave taken.0
