Garden Boundary Fence problem

Firstly, if I have posted this in the wrong section, please accept my apologies....
A previous neightbour fitted a timber trellis to the top of a boundary fence in my garden.
The vertical posts of the fence are actually in my garden, which I always assumed meant that the fence was technically mine and part of my property.
The trellis is very old and now prety well rotten. There is thick vegetation in the neighbours garden, which probably caused the trellis to become partly unattached from the fence; but is probably now actually holding it up.
Now I see the neighbour has used wire to tie this 'falling trellis' to the horizontal timbers on my side of the fence.
If the trellis and vegetation fall, this could seriouisly damage my fence
What legal ramifications are involved here ?
I have tried talking tom the neighbour, but he seems to want to live behind high vegetaion and not interested in doing any pruning etc.

I would also check on your deeds as to exactly which boundaries are yours - we thought when we viewed our property that the left hand side fence at the back was ours - it isn't lol! Different properties have different layouts - and previous neighbours may have gotten along well resulting in the fence posts being on your property, but that doesn't necessarily mean that they are yours if that makes sense.Avon Lady since 2009 - I help on the Avon hints & tips thread to help other reps/new sales leaders as I was helped so much by it when I first started out :A0
