Well if it is the case that the property is BTL, then situation is grim.
It was unclear as to whether the property was the primary residence of the lady and she took in a tenant or it is BTL but she lives in it. Either way, I assuming, she is in breach of mortgage agreement, am I correct?
The court has been lenient in awarding her suspension order previously but she did not honour it because it appears that she promised something which was not possible, such as getting a job with an income that will enable her to make the mortgage repayments (possibly to make the increase payments to include the arrears and court fees?)
Lying openly to the court will not be viewed sympathetically, this why they need to put forward their watertight budget sheett and come up with a realistic solution, am I right? and also since the lady's daughter is named in the agreement, she will be responsible for the repayment, and since wockawocka is cohabiting and sharing financial obligation with the lady's daughter, he will be brought into the picture, right? This was the case for me.
Anyway, I agree with you that repossession is inevitable, unless they can sell the house first. It is worth making a plea in court. The court may grant suspension of repossession, especially if the lady lives in the property.
They will lose out far too much if they allowed repossession and it is worth it to attempt selling it on the market quickly.
