Arrears notice for loan I'm not in arrears with?

Hi all,

I just got an arrears notice from Black Horse finance for my car loan, all very official saying that it was being sent to me as I am in arrears with them, it then goes on to say that the total overdue is £0.00.

They also included a nice little leaflet telling me what to do next.

So I called them and asked them why I had been sent an arrears notice when I am not in arrears, and the woman I spoke to said it was a standard letter - and they have to send them every 6 months.

I queried this, and asked her did she really mean that everyone will be getting arrears notices even if they are not in arrears and she said everyone will be getting a statement under the new guidelines, fair enough I said, but this isn't a statement, it is a formal notice of arrears, which I don't have.

Is this right then? is everyone having to get a notice of arrears even if they aren't in arrears? I just can't see that as being correct? :confused:

    I would ring back and ask to speak to a manager to clarify. Also, check your credit report - does it have any untoward information against your Black Horse account?

    Since October 2008 lenders have been required to send Statutory Arrears Notices on accounts that are two or more monthly installments overdue. Assuming the account is not brought up to date then further notices have to be sent at 6 monthly intervals. i suspect that this is what the nice lady is referring to.

    If the account is brought up to date the whole cycle starts again.

    This only applies, of course, if the account is in arrears - so what you have been told by Black Horse is, rather aptly, best described as horsesh!t :confused:
