Ex-employer filed a defence!!!

At the eleventh hour he has filed a defence! Don't know what it is yet, but I will find out on Friday.

To add to my woes, my salary cheque (yes - my new employer pays by cheque!) has gone missing in the post. I have to post it because I work nine to five and the banks are only open when I am working!

This means that my first DD's to pay my debts are going to bounce today.

    They may have filed a defence, but they are still in the wrong, so try not to worry too much! I'm sure things will still go your way!

    Any chance if you call your bank to explain that a cheque has gone walkies they'd giveyou an overdraft/extend your od to cover you for a few days whilst you sort it out? Might be a good time to convince your employers that BACS is the way to go as well ;)

    So sorry to hear your news about the employer defense thing - makes my moaning seem v. trifling! Chortle has a great suggestion about phoning your bank - get straight on the blower at 9am and try and not let anything bounce.

    At least you know that you are in the right and although its going to be v. stressful, stay with it and hopefully it'll all work out perfectly.

    ouch,,, try to keep a smile on your face.. sure that the cheque will turn up soon.. ( could you not ask your new boss to write you another cheque and put a stop on the one that was posted),,,good luck

    Hi Sammy 115

    I do the wages by cheque for the company i work for they wont change to BACS either, but i do one company cheque to cover all the wages (theres only 5 of us) and have paying in slips off everybody so it is all paid to them without any hassle. It does take a day or two to clear for them but they are happy because they dont have to go to the bank.

    Would your employer do this for you or pay your cheque in for you when they go to the bank?

    They may have filed a defence but because they have done it so late this will have given little time to work out a response and the court will see that and I still dont think they will be happy and may well give you the benefit of any doubt.
  • ohhh sammy115 i am so sorry to hear all these things :( it looked like things were on the up, lets hope the court still sways your way though :p i dont know what to say about the cheque but grrr, how annoying, hope you can sort something out though :)

    you could ring the bank and cancel the DD's now. that way you will avoid any charges.

    you could also check with your bank if you can pay cheques in at a cashpoint - that way you can do it yourself any evening and you will get a receipt plus no missing interest for 2 days for it being in the post.

    i know you can do this at lloyds and nat west and probably at others
