Hi, I need a little bit of advice please :o

I had a loan with HBOS (approx £5000) in which I defaulted on (numerous times). In the end I was sent a letter stating that if I paid £2440 (either in one or over 3 months) then the debt would be written off. They wanted this paid by May 30th. I contacted them stating that I could pay this money but it would not be available until June 15th (consolidation loan). They were happy enough with this.

I got my consolidation loan through and immediately contacted HBOS to pay off the amount. End of or so I thought.

Soon after this I started getting letters from CapQuest requesting this full amount (£5000) I called them numerous times (useless) and also went into HBOS. HBOS agreed that it was cleared (have a letter to state this) and to ignore further correspondance from CapQuest.

I was then getting weekly letters from CapQuest demanding this money. Threatening to enforce legal action etc. Every time I phone them up they said they could see the money but were waiting for there client to respond? Then I got a letter demanding £800 for legal costs?

I then obtained my credit report. CapQuest is showing on it as a default for this loan and for the £800 legal costs. I phoned them and they were incredibley arrogant down the phone and stated that the tapes hadn't been updated. Checking again I can see that the tapes were updated on 15/10/2009 and its still showing as a default for every month since May 2008. I accept there will be a default from HBOS but it looks like CapQuest are still looking for this money which has been paid.

HBOS have admitted they sold the debt on but what can I do? I've got correspondance stating the amount is clear (from HBOS).

Also I've since moved but never updated CapQuest of the new address as I was told it was cleared.

How can I get this removed from credit report? And sorted out?

Any suggestions are greatly appreciated.

(PS I hope it makes sense, any questions please ask and I will clarify)

    make a formal complaint to hbos in writting and follow their complaints procedure they will get there finger out. Secondly never talk to monkeys at capquest or any agency on the phone as they are there to twist words and get power trips, write to the monkeys telling them that if they dont sort it you will log a formal complaint with the csa about their conduct and failure to investigate when a debt is in dispute.
