CSA Arrears

Another question regarding arrears. I owe the CSA £4500, a debt from 1995/6. I have been paying the full monthly amount without missing a payment and £15 towards arrears since 1997. Obviously, the CSA are now hounding me for the full repayment of arrears. I am now repaying £32 a month towards the arrears but this will take a number of years to pay off. I have now had a phonecall from the CSA stating they may pass the arrears to their debt collection department. I cant get a straight answer from the CSA regarding repayment so what I would like to know is

1. As the debt was prior to 2000, I dont think they can get a LO but can they get a DEO for the arrears considering I have been making full monthly payments??

2.What options are open for the CSA to recover the arrears considering they are so old.

3. Is there a formula that the CSA use when working out repayments of arrears that I can find on the internet?

    They normally aim to get arrers in within two years but are flexible.

    In my case, im a NRP, I ended up in arrers due to maladministration on their part. Therefore they have given me an extra year without any kind of hassle.
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    They can impose a DEO at any time and don' t need to apply to get one!

    they'll just take what they like up to 40% of your net pay. legally too.:mad:

    My particular circumstances are similiar, but my case is now closed, but still have arrears to pay. Just had them on telling me that the remaining 6years it will take me to pay off the arrears debt is too long, and they want me to pay more to pay it off quicker. As I agreed some time ago, that this payment would be made month in month out, until the balance was paid, I expected the CSA to stick to it. NOW, it appears they have a new remit, and that is to get money in FAR QUICKER than before. Just spent 2hours trying to get this sorted out. They are beginning to sound very much like a debt collection agency. AND THEY ARE TRYING TO ENFORCE DEO/AND even getting me to pay by credit/debit card. At present I have no job, so am wondering how they can do this. Surely that would force me in a NEGATIVE situation.

    The CSA has told me, that it is a NEW DIRECTIVE and they are chasing people to clear debts. No negotiation, no discussion...PAYUP or face the consequences??

    Any suggestions?

  • I am in the same situation as posted last week, I contacted my MP and made a complaint on these heavy handed techniques on debt recovery.
    I would urge all to follow the same example and highlight this to their MP ,if enough people complain they may alter this approach.
    What a joke a government department having a purge on debt repayments within two years, pot kettle black :-(
