Citation and Time to Pay Direction (Scotland)

Hi,
I've recently accepted that I am heading towards bankruptcy after exhausting all other avenues. Through this forum and debt support I managed to get out of my marital home in July and set up in a rental. My ex is still staying in the house, although we've stopped paying our debts and mortgage since around the time I left.
I received a citation for court last week, with 21 days timeframe and a "time to pay directive". We have no option but to go bankrupt, our concern is that my husband is not yet ready to move out and rent. Can someone advise how to respond to the summons? Do I tell them I'm going to be going bankrupt? Do I respond at all? Would the next contact be my statutory demand?
I've just went off work with stress for the first time in my life and I'm finding telephone contacts really difficult at the moment. I contacted CCCS who want to look at all my options again.
I'd be grateful for any replies.

I got a response from the Scottish Debtline. The citation I've received is the first stage of court action. It's my amber light towards applying for my BR. I've been advised to sit tight and ignore the time to pay directive and wait for the 'charge of payment' to come next."Money doesn't talk it swears" Bob Dylan0

I'm glad National Debtline were able to help you. The "Time to Pay Direction" form is an option open to people who are able to make arrangements to pay back a single debt. The application form is included as part of the paperwork if you get a summons for a debt.
If 'time to pay' isn't a real option for you, then National Debtline are correct - don't fill in that form.
