Please help me - Solicitors letter received

    From what I can tell it is probably worth going on the attack lol

    Send CCA requests to everyone and claim everything back that you can, charges and even try with the PPI! You never know until you try.

    At the least it will buy you some time as I dont think they can take any enforcement action while the accounts are in dispute.

  • Interesting comment euronorris. I recently applied for a card and when I received the documents I didn't like the terms. So I sent back the agreement with "No longer required" scrawled all over it. They still sent the cards anyway. Does that mean I am not liable for any debts on the card? That’s a nice thought.

    Just dont use the cards and close the accounts then.....

    They would know you spent the money so you are still in a sense liable for the debt, but if they haven't got a signed CCA then they can't enforce it in court so can't force you to pay. That is if the card was pre april 2007, rules have changed since then.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    They added 10k to this debt in a year? Doesn't that sound hookey too?

    After reading so much on the subject it strikes me that letter is using family and so on as leverage ...which isn't legal. They can't involve or discus, (or threaten to) your debts with third parties I understood.

    Ceebee is right ...NID is the man likeliest to be able to put this in perspective.

    Physical/psychological harassment
    2.5 Putting pressure on debtors or third parties is considered to be oppressive.
    2.6 Examples of unfair practices are as follows:
    i. disclosing or threatening to disclose debt details to third parties unless
    legally entitled to do so
    j. acting in a way likely to be publicly embarrassing to the debtor either
    deliberately or through lack of care, for example, by not putting
    correspondence in a sealed envelope and putting it through a letterbox,
    thereby running the risk that it could be read by third parties.
