O2 DEFAULT and MOORCROFT CCJ same debt!!

Hi all,

I have recently been trying to clean up my financial act and have just discovered that I have a CCJ on behalf of Moorcroft.

But what I have also discovered is that I have a DEFAULT listed by o2 and it is for the same debt.

O2 was the originators of the debt and they must have passed it onto MOORCROFT without my knowledge as I have moved I never received a Default Notice from O2.

I have been in contact to get the debt paid, but I asked them if they issued me a DEFAULT notice as it was my understanding that they can not issue a DEFAULT unless I receive a DEFAULT NOTICE.

This is what O2 said:

Thanks for emailing us about your credit report and default notice.

I'm sorry if you didn't receive the default notice. We do send letters or emails about the outstanding balance on your account. However, I'm unable to confirm if a letter or an email was sent to you. You'd the option of viewing your bills and balance online.

Unfortunately, we can't remove the entry from your credit reports or change the start date of the default.


What I am wondering is, can I get the CCJ removed from my file or the DEFAULT removed?

I am willing to pay the debt back, but I am not willing to pay the debt back twice over.
I would only be willing to pay O2 if I was honest.
Any help would be great.

    Pay O2 the debt if you are happy to do so ( DONT pay Moorcroft!) ask for their confirmation and also ask that they remove the Default....they HAVE to!
    Also tell them that they should instruct Moorcroft to remove their Default, if either of them fail to do so you can report them.

    Keep copies of all paperwork, pay the debt by REGISTERED POST ( not Online!) and ccheck that it has been delivered. Its slightly more expensive to do it that way but it gives you peace of mind when they f**k it up, which they inevitably will!

    You can apply to the court to have the CCJ set aside on the grounds you never recieved the court summons/paperwork.

    Defaults can be removed they don't have to. Often they will make them as satisfied instead. As part of any arrangement to pay them off you would stipulate that if they want full payment now it must be removed, and you want that offer in writing.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    So heres the situation:

    O2 DEFAULT

    MOORCROFT (collecting on behalf of O2) issued a CCJ

    I am in contact with O2 to pay the debt, so far they wont budge to remove the DEFAULT i would like them to though.

    So what I am wondering is, should I offer O2 a repayment plan which they have to agree with and the stipulation being that they remove the DEFAULT off of my credit reports.
    And at the same time apply to the court to get the MOORCROFT CCJ set aside.

    Surely if I was to start paying O2, and I got the MOORCROFT CCJ set aside it cant come back to haunt me because the original debt (O2) would have been paid off, and I think I'm right in saying you cant pay for the same debt twice over even if it is through 2 different companies.

    Help needed!!
