dca threats

hi everyone,

not posted in a while but just have a query.

my friend has debts and although she is not considering br she is trying to pay.

long story short, she recieved a letter from a dca saying that she hadnt been in contact (actually she has but we know what these dcas are like!) so they were writing to inform her that they were going to check her credit file and see what was there if it appeared she was a home owner they would seek to place a charging order on her property ect blah!

she has no property so it didnt matter but my question is can a dca search your credit file without your consent? i thought you had to give permission for anyone to do a cerdit search/ am i right or wrong?

    I always thought you had to give your consent :confused:

    Hopefully someone will be able to tell us for sure. Bat is usually good at that sort of thing.

    Technicaly, you gave consent when you signed the credit agreemant with the creditor, for them to do 'periodic' searches. This is usually so they can decide whether to increase your credit limit, but can justify this too, although this can be seen as stretching it a bit in some cases.

    Would depend on the exact wording of the agreemant at the time, but its mostly a waste of time complaining about it anyway, the CRA side with the creditors and the ICO side with the CRA when or if you complain:rolleyes:

    i said i wasnt sure they could but will pass on your knowledge. i might suggest she ccas them as it was littlewoods catalogue and no agreement was signed she was naughty and never sent it back!!! now why didnt i think of that one!!! lol

    it doesnt make any difference as she rents her house and has no mortgage ect ( which appears to be the best way these days)

  • It wont matter that she never signed the agreemant, as it was agreed to when she ordered from them.

    At least thats what they insist, i know littlewoods well;)

    But at least without a signed agreemant it may make it easier to deal with if they try court action in the future

  • Hi all, could someone please give me some advice as to what I should do next please, I got behand with my payments to littlewoods catalogue so they put me on a payment plan, well 2 months ago I missed a payment and last month I paid 30 pounds ( less than the agreed amount ) now nationwide debt recovery wrote to me yesterday and my first thought was to give them a call later in the day anyway they phoned me within an hour of opening the letter, they were very rude and demanding so I put the phone down, today they phoned again just as rude and demanding. My question is I have had the account for many years and they have always charged for late payments and admin and I want to recover these charges do I talk with the DCA and make an offer of payment or what, not sure where I stand or what to do next, I feel sick with worry.
