can anyone give me some advise, my hubby and I lost our house throu redundancy many years back and we have been paying off the amount of £30.000 . They have capped the amount at £7.000 and now owing is £5990.00 some years back the letters where just being addressed to myself now out of the blue they still want the £5990.00 from me but say that my husband as defulted on payment and want him to pay the £30.000. payments that we have paid we thought counted as bothof us paying.:confused:

    If the mortgage was originally joint, then the shortfall debt was joint and the arrangement should have been made as a joint one unless you were separated at the time. As with a joint mortgage debt if they feel that one party has not maintained the payments/arrangements they will chase the other party. Of course they could just be trying a fast one or made a mistake!

    Well worth speaking to Shelter, as you have got the debt down as far as you have and if you have some funds it might be worth making them a full and final settlement offer. Get some advice from Shelter :)
