Question about Early Discharge

I have just received a letter from the OR saying that he is taking into consideration giving me an early discharge. The letter states that in order to evaluate my current circumstances, I need to fill out the form which came with the letter. The form asks questions about my income and expenses, similar to the form I filled when I filed for bankruptcy. The letter went on to state that I needed to fill this even if my circumstances haven't changed since I declared bankruptcy (which they haven't) and that I need to send this form within 14 days or I will lose the opportunity to have myself considered for early discharge. Also, the letter said that this would be sent to all my creditors to give them an opportunity to raise any objections to my early discharge. Finally, the letter said to not badger the OR about whether I would get the early discharge or not and that he would write to me once a decision had been made (though he didn't use those worlds lol!).

Needless to say, I will be filling this immediately and sending it off my registered post tomorrow. I will be keeping all my fingers crossed and hoping for a positive outcome. This bankruptcy has not had any impact whatsoever on my life. I have no job, no property, no family or house so my life has continued pretty much as before expect for the fact that my bank account was closed and I now have a Coop Cashminder account and I get dozens or unsolicited debt advice calls a week. In fact, it's had such little impact on my life that only my mother knows about this. Not even my father, who I live with, knows about it. So really, it shouldn't bother me too much whether I get an early discharge or not but it does. I always feel like it's something hanging over my head and I want it over with.

Has anyone heard of a person who was considered for early discharge and then, once the OR had received the form, been refused an early discharge for whatever reasons? My circumstances are the same as when I declared bankruptcy and I have no fixed income that could be shared with my creditors. I have a temping job where they call me maybe for two or three days every two or three weeks and my monthly income is maybe £200 on average. Whatever I earn I give to my parents towards my rent and living expenses (even though this doesn't really cover what my parents spend for me) so there is absolutely no money left over for anything. Could the creditors object simply on the grounds that I should be "punished", so to speak? Any advice or information would be greatly appreciated!

    I think you should stop worrying about it.

    ED is not a sure thing. You may or may not get it and there is no rhyme nor reason as to why you may or may not get an ED; there simply are not any rules you can follow to get it. Its not just the creditors (most don't bother replying, its a waste of their time/resources/money etc), its whether the OR has the time to deal with all the paperwork etc!

    I had a simple case, not working so no income or IPA, none of my creditors complained and I had no assets for the OR to realise. I didn't get ED and saw out the whole 12 months.

    Hi both myself and hubby went BR 05th Nov 2008 had forms early July sent back straight away had IPA set for 01st Sept but heard nothing about ED I assume that they are so busy that they will just let the BR run its course and AD on 05th Nov 2009 however I keep checking register everyday but resigned to the fact that ED won't happen due to AD only being 2 weeks away

    We lost out on ED as JUST ONE of our creditors objected to it :mad: :mad: :mad:

    So we wait the FULL 12 months until Jan 2010...

    Life hasn't changed much ~~~ Apart from I don't need to lock the doors & windows 24/7 now :T :T :T

    Did the OR tell you that the creditor refused or why the creditor objected? I'm trying to understand for what reasons I might be refused.

    its very rare for a creditor to object when being put forward for early discharge..half the time creditors dont even bother to reply to the OR's questions anyhow!...i've only seen the odd one or two so would be interested in the response..

    No he didn't ~~~ But I the fact that owed this creditor £300,000 may have something to do with his objection...

    PS It was a private creditor not a bank etc...

    So I guess the b**tard was just being vindictive? As if keeping you bankrupt until AD will get him his money back....

    Anyway, all my debts are with banks and credit card companies so I'm hoping that they are not feeling too vindictive. :D
