Help needed

Hello

I need some advice, I have already handed in my notice and have said initially that I am prepared to work until the end of January (I only have to give one month's notice) so have given them plenty of time to find a replacement which they have already done and they are due to start in two weeks. My question is this, I have holiday booked for December (all of it) but now am thinking that I do not wish to return to my employer once the holiday is over.

a) are they entitled to say that I cannot have my holiday
b) if they say that - where do I stand.
c) is there any problem with changing the date of my leaving, bearing in mind I will still be giving the one month's notice, although I will be on holiday for the period.
d) if they fail to pay me at the end of December, what are my rights.

I would like to thank everyone in advance for their help.

    Your employer can refuse your holiday request, but he would have to pay you for any leave untaken at the date you leave. If he does not do so, you would have to take him to an ET for failure to pay holiday pay/unlawful deductions from wages.
    He has agreed a leaving date and has the right to hold you to it - any change would be a matter for negotiation.

  • I would agree in part ie the bit about holiday.

    However, your contract states 1 months notice. If you now state that circumstances have changed and you wish to leave at the end of December on completion of your holiday, then it is longer than a month and the Company have to accept it. It depends on whether you want to leave on good or bad terms really.
