Hi,

We are coming to the end of our season, we will have worked 8 months, and we thought that we would have got holiday pay at the end of our contract, we have been told by our boss that he does'nt pay holiday pay, as it is included in our salary, there was no mention of this at the interview, and it is not in our contract of employment. Can anyone help?

  • If it is not in your contract of employment then I am afraid he will have to stump up for holiday pay. You have a genuine belief that holiday pay was in addition to basic wage and expected same. You are legally entitled to 28 days (can include bank holidays) therefore you would be entitled to 8/12ths of that (18.6). Write to him asking for the payment stating that it was never discussed with you and you expect holiday pay.
    If he does not pay up then write again stating you will take it to ET if payment is not received within 10 working days.
