Overtime

Hi

Hope this is the correct place to post!

My OH works in a manual job, he has a works van as there is alot of kit to transport for the job. His usual hours of work are 40 per week - 8 till say 4:30 with 30 mins lunch. Due to the nature of the job he is rarely home on time as many of their jobs are out of county resulting in potentially a fair amount of overtime.

Recently the company have decided that they will not pay the first hour of overtime per day. This is because, according to them, the first half hour of a morning ie 8-8:30 is spent loading the vans with the equipment for the job and therefore uproductive. The last half hour of the day is to take away 30 minutes travel time home but this is regardless of whether they go straight home or to the office first.

What I'd like to know is whether this is allowed. In my job you are not allowed to claim for the first 10 minutes of going over your hours which is fair enough but I would consider that the loading of a van is part of a days work!!!

They have trackers on the vans so there is no issues with them being unable to clarify how many hours were spent on site!

I hope this makes sense - I have looked for other threads re this issue but cannot find any.

    It might be worth checking out your husbands contract and see what it says about overtime. Its likely it will be at his managers discretion which means what they are doing is legal. Sorry.

    The time for loading is working time. If that is included in hours worked but is not paid, how does than affect compliance with NMW?

    Do his written particulars of employment show he is paid an hourly wage or a weekly one?

    Check his contract and any & all relevant supplimentry hr policies.
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.
