Being taken to court after BK

Hi

My OH has received a court demand for an accident he had 2.5 years ago for personal injury. There was no damage done to the car so he even kept his NCD (he did inform the insurance company at the time). Apparently she developed whiplash, and is claiming thousands in lost work etc. I expect you all know the type of claim we mean! The claim is based on excessive speed, lack of care and attention etc - despite the fact her car wasn't damaged :confused:

He went BK in June. We are really confused as to why this demand has turned up now (it's for around £15,000), addressed to my OH rather than the insurance company, and whether he actually has to accept it or not.

Will he actually have to pay it? We are really panicking now!

    Does he have legal cover? I'd send it to the insurance co and let them deal with it.

  • As he reported the accident to his insurer, it should be down to them to argue/pay it, after all that is what you pay insurance for.

    Have you contacted the insurer abot it yet?
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    Yep i'd agree....I had some paperwork sent to my after an accident that in fact should have gone to my insurers...contact them thats what they're there for..

  • Thanks guys. Not helped by the fact this was before he met me, he has no idea who has insured with at the time. However he does know the insurance broker, who ought to be able to help.
