Claiming JSA after quit job

Has anyone been successful in doing this? I am currently claiming and its currently processing. The girl at the office said I should be paid on Wednesday of next week and there just deciding on my entitlement. I put down reason for exit was down to harassment and unfair work conditions although I have no proof I think they may take my word for it. Anyone been in similar situation?

They won't take your word for it, its tax payers money you know. They will write to your employer and if their reply suggests you left of your own accord your claim will be sanctioned whilst they investigate, you may qualify for a hardship payment during this period. Your claim can be disallowed for up to 26 weeks.

You seem to have already asked these questions why are you asking again?

If you walk out of your job voluntarily, you have got absolutely no chance whatsoever of claiming immediate jsa(possible suspension of upto 26 weeks). If it comes down to your word as to why you left your job voluntarily against your employers, it will go down to a decision maker who will always side with your employers. You will need concrete evidence e.g to be backed up by a work colleague or to get a doctors certificate to state that you are unfit to continue in your present job if you leave through medical reasons

In reposne to your question, if you leave a job voluntarily, eg you quit and you apply for jobseekers allowance and are waiting on a decision etc, they always side with the employer especially if you quit your job, you wont be able to claim jobseekers allowance for 26 weeks - However you can claim hardship allowance (not alot of people know this), its not much, but wil help you in the long run.

If you are sick etc, would advise you to put a claim in for incapacity benefit and if you are really struggling for money to pay your gas/elect etc - apply for a crisis loan for living expenses (you local DSS will give you the number for this).

    Cheers

I walked out of my last job and told my employer I wasn't coming back. She decided to send me a letter a few days later telling me I was sacked.

When I put in a claim a few days after that I told the jobcentre I left my job due to harassment and unprofessional conduct. They said I'd get my money while they investigated what happened. Well I carried on getting my money for almost a year until I got another job... I never heard the result of their "investigation," I don't know if my employer told them I had been sacked or what.

Wrong. I got a call today to confirm my claim has been approved and payment should be with me tomorrow. They said absolutely nothing about a 26 week sanction. They never asked for proof of why I left my job or a medical certificate. They took my word for it, which I am thankful to the state.

As above they accepted my JSA claim and didn't say anything about hardship funds, crisis loans etc.

Hi Matt, good to hear you got your JSA. My claim was accepted due to harassment and unfair work conditions, but never mentioned anything about an investigation being carried out glad. When I left of my own accord I didn't get any letter just a P45. I had a look at there terms for leaving on your own accord and I think if you fall under 1 of the heading they accept it. I don't think they look into it and get into a legal wrangle etc The list if I can remember was harassment, religious discrimination, sexual harassment, violence, stress, effects your health and saftey and traveling/relocation.

*To anyone out there applying for a JSA while leaving your job for reasons above I would say don't hesitate go for it you got a very good chance to get JSA without this investigation, your word against the companies word. Yes its there in there rule book but I don't think they apply it unless its a ridiculios reason for leaving like just didnt feel like going back??*

    Good luck.

AzimScot, I think you may be jumping the gun. Your initial claim will be assessed to see that you fulfil the usual JSA requirements, this is what has happened to date. At some point they will then write to your employer, and compare your statement to the information from the employer. The DM will then decide whether to apply a sanction. This could take several months due to current backlogs.

Yes, I think the JSA people changed the rules so that anyone who did claim jsa after leaving their job voluntarily will be paid immediately until the DM has the full facts from both sides as to why you left the job. You could still eventually face a suspension of jsa for upto 26 weeks.

I get what your saying, but it doesn't make sense that they are paying me for the moment that I do not deserve as 7 months down the road they may change there mind? Will they want the money back 7 months down the road it sounds ridiculous. Why would they give me it in the first place. Oh well we will wait and see, but so far to date they haven't asked for an in detail story from my side.

Do you have a website link for these rules? Isn't the decision makers supposed to let me know all this before accepting my claim?

my OH left his job for the same reasons, got his JSA and 3 months later
payment was suspended for 8 weeks.

If you had to wait on the decision maker you could be left with nothing for months while they investigate however many claims are before yours and wait on employer responses
