Not sure of the terminology???

Hi there,

I was declared BR on 02.09.09 - I wasn't given an Order thing?? to pay anything back due to being in receipt of benefits with 1 child.

I am currently studying my Childcare NVQ 2 and will be going straight on to Level 3 (before xmas I hope)!

My question is......due to not having been giving one of the payment Order things, if I got a part-time job, say a lunchtime assistant in a school (I think it's around £6ph), do I need to inform the OR of this income???

Also, I have seen in my local Asda store that they are advertising vacancies.....if I applied to work a couple of hours a week (not sure of wage), again, would I need to tell OR?

I am aware that the extra income will effect my benefits, but it would be that little extra coming in per week if I did part-time work.

What is the maximum amount the OR will allow before they want some money back (if that makes sense)?

As I said, I was NOT given an Order, they were not interested in my car (worth approx £300), so as far as I'm aware, my case was pretty straightforward.

Any advice would be appreciated,

Thanks

Yes, you need to tell them of any changes to your income. Chances are since you are on benefits you won't need to pay an IPA anyway, but when you went BR you agreed that you would tell them of any changes within 21 days, so yes you do have to.

Your surplus (not including your benefit income) has to be £99 before an IPA is applicable.

  • Thanks for the advice.

On a seperate matter...if you don't mind me asking, I noticed you were ED in 6 months. Was that due to your own BR being straightforward with no Orders attached?

Don't mind you asking at all. To be honest I am amazed I was granted ED - I am self employed, I have a house (which they are still to deal with) and a fair portion of my debt was business related and HMRC.

So I guess the only thing that proves is that it is totally luck of the draw - there's nothing set in stone to say that you may or may not get it. So you never know!

I didn't have enough surplus for an IPA. Thought I would probably get a BRU (lots of what could be seen as unreasonable expenditure towards the end of last year) but that didn't happen either.

  • Fantastic for you :j

Sorry to be dimm......once you are discharged, does that mean that the OR will NEVER need to be told or would take an interest in any monies that you had coming in????

Once you are discharged the OR needs know nothing about you. UNLESS someone passed away during your BR (or before) and you get the inheritance afterwards. Thats about it.

On a P/T job at 6phr, you are not likely to get an IPA at all. (thats the order thing!) You must tell the OR whilst you are BR about any changes.

Myself, I started BR on benefits, finished BR being a dependent of a waged individual so still no income of my own. No IPA was implemented but I did the whole 12 months. Nothing was realised from my assets so there was nothing to gain; I was a straight forward case. But I went all the way. There is no rhyme nor reason to ED.

    Thanks :)

Yes that's correct - unless you have an IPA set up in which case you still need to tell them about changes in your income. Or unless the money comes in from a will of someone who died while you were bankrupt.

  • Many, many thanks both.

It is worrying as to whether I should even bother seeking part-time work, if the OR will then want some of the money I earn.

There is no other income coming into my house (I am a single parent). I justed wanted to try and get myself back on my feet, but thought "well what is the point if the OR will then take my extra income off me"?

I think based on the advice you have given, I can now look into getting a p/t job! As the Sainsburys ad says "every little helps"!!!:rotfl:

Just let the OR know and he will note it on his file, but the sums of money make an IPO very unlikely indeed.
