Question about part-time and holiday entitlement

evening all

just a quick question

if you are part time and your scheduled hours don't include a bank holiday but your holiday entitlement does include them, do you "have" to take that day as holiday?

i am employed on a 20 hr contract and have been told that if my rostered day off is a bank holiday i have to book it as holiday out of my entitlement :mad:

is this legal? :confused:

    The way I do it at work (where I work out the holiday entitlement and very few people work 5 days per week) is that I 'give' all the full-timers 20 days' leave, plus 8 Bank Holidays, then 'book' the 8 bank holidays off for them and take it off their leave entitlement so they are back down to 20 days.

    Then for the 4 days pw people, I 'give' them 16 days' leave plus 6.5 for the bank holidays (4/5 of 8 rounded up). Then I book the bank holidays they are due to work off, which may leave them with more or less than 16 days' leave. If they are left with less than 16 days' leave they can work the hours at a different time.

    We have one section which is open 24/7/365, so I don't book any Bank Holidays off for them, if they want leave on a BH, they book it.

    Actually my employer is more generous than that, but I'm giving the statutory minimum for convenience. It gets even more complicated because we usually shut the main office between Christmas and New Year, so full-timers are supposed to keep 3 days A/L to take at that time. But I also have to work out what the part-time equivalent of that is, and round it down, and work out what days people would actually work. Fortunately no-one stresses about it too much, because we have a good system for taking TOIL and most of us are regularly 'up' on our hours rather than 'down'.
