It is quite satisfying knowing that these people have been sent running back to the rock they crawled from under with their tales between their legs now having to repay what they borrowed.
It seems the fog-horns on here spouting yuppie boy legal fallacy have vanished from the forums - yay, so now we might actually see some legitimate "Money Saving" advice being posted and for those of us in a financial pickle some good advice on how to "Manage" the debt and negotiate with creditors, not some deluded wannbe finance expert posting crap about debt evasion et al.
So here is a big pat on the back to all of us who are riding it out and doing the right thing by repaying our creditors and as a final thought to the losers who tried and failed at Debt Avoidance 101.....sweet! :beer:
Proliant, you're still not going off on one about this are you? I thought you'd given up, being the facts do in fact speak for themselves and the main factors remain, a debt can be made unenforceable and will continue to be the case.
The highlighted case here simply refers to the actual reporting of data, not the way in which unenforceability will change for the future! I've always said that those that wish to pay for a debt they do not legally owe are the mugs, not the savvy people who realise their agreement is unlawful and so seek to avoid paying due to the banks inability to issue a legally binding agreement.
You'd be the first to jump onto someone that issued you a dodgy agreement for work done so some of what you say doesn't morally add up within your own scope of intellect.... i.e. I hire you to build me some server racks and we agree a price. You build them and I suddenly cancel at the last minute - but nothing in our agreement allowed for this - would you foot the cost for the work to date or sue me?

...what would I do? If I was in financial distress I would work with the lender to try and sort out a payment plan first, if that failed I would wait for the court date and show the judge my letters offering the lender a token payment and my income/expenditure etc and if that failed.....fcuk it! Bankruptcy.

Ok, Ok - i'll lose this debate (again) so best I run along now haha...... But the way I described it was assuming I owed you money and then dumped the cost on you at the very end by walking away without paying you. Basically, trying to point out that you'd have no option but to seek your costs back via the courts. Thats all these guys are doing, due to an unlawful agreement.

Holiday was great thanks - just a shame to be back in cold cold UK! But could be worse, I could be earning $20 Peso a month for doing a 70hr week like the Cubans :eek: :eek: :eek: (I tried to explain unenforceability to one of them and his reaction said it all - how do you get a credit card with 10 years salary on it)! kinda funny if not true (in their culture)! :cool:2010 - year of the troll
