At what stage do you agree your IPA? + early discharge??

If you can't agree to an IPA, then the OR can go to court for an IPO (Order).
However, the allowances are quite generous, certainly when compared to a DMP or IVA.
You can try and negiotate on the amount, but not the length of time.0 -
Thanks :-) I'm not going to force an IPO but I guess there's no harm in pushing for a more generous IPA - certainly not agreeing to their first request straight away?! I hadn't even thought about challenging it at all until Three Clicks put the idea in my head ;-)

but once I went BR I'd actually have quite a bit of surplus after my 'reasonable living costs'. So I doubt very much they'd let me get away without doing an IPA?? Would be lovely if they did but then I'd be getting away 'scot free' which even I would feel a tad guilty about

It is possible you wont have quite so much ''spare cash'' each month as you think?
Even if you do have the amount you say, as 'surplus to requirements'.....BR isn't a punishment for wrongdoing...you haven't done anything wrong.
If you can afford to pay 700 a month now, yet still have a decent standard of living, then , why not consider it a 'pay cut', and live within your current means? It is only 3 years from imposition..and if you find yourself in more dire circumstances, then negotiation with the OR sorts that out.....the sum paid on an IPA is negotiable, and can be varied, depending on circumstances.
The NT refers to the fact that, on BR, the HMRC income tax gets put into the BR pot as well as all other debts....hence, a BR pays no tax.....for that tax year....[subject to certain rules.]No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
Hmm no I haven't done an SOA yet - I'll try and find the link. But I'm single, living on my own and don't have any major outgoings other than the usual stuff along the lines of:
rent £600
insurance (home) £25
insurance (car) £24
Water £25
Fuel £40
Council tax £77
Phone £20ish
Mobile £30ish
...and my take-home pay is around £2.5k. Even with food/clothing/travel allowances on top of what I've listed above, I'll still have surplus of quite a bit I reckon?
As I said, it seems crazy that I'm having to think so seriously about BR when I earn ok money - but my ex has dragged me down...defaulted on the mortgage for several months, and a secured loan on our house, and I've also got about £18k of credit card debt too (which is in my name but was largely spent on trying to keep his business going...which still failed!). Plus our house is in about £30-40k negative equity so we can't just sell and sort that bit out.
Also, one of the biggest appeals of BR is that it will remove the constant threat I've had over the past year that he will drag me down financially at any time. Even if we managed to avoid it now, he could just stop paying the mortgate again at any time and drag me into BR. If I'm going to do it I want to do it now and get it over with asap rather than two years down the line. And, as we can't sell the house due to neg equity it could be years that I'd have this hanging over me.
Is that naive or sensible I wonder?!?!
