hello all
i was looking for a little advice regards BR.
I have had to resigned and finish with my job earlier this month due to family reasons. My father is ill and his health has taken a turn for the worse so i need to move abroad (non EU country) to care for him as he is alone.
Anyway, as I am now no longer employed and have no income and will be moving abroad for the foreseeable future, I have been advised by the National Debt Line that bankruptcy is an option I should consider. They are sending me some guides in the post.
I need to leave the UK around 25th Oct, would you suggest BR is the best option available? Is it possible go BR on such short notice from the UK (i live in London)? Or will I need to do it from abroad? I can get the cash to cover my bankruptcy from my overdraft.
I have no assets or savings and i am in around £25,000 debt - credit cards, overdraft and a mobile phone contract (10 months to go) which i will need to break.
Prior to this I had no problems paying my debts off always on time and not missed any payments.
I got paid from work for last month and I can only pay this months bills after that I will have no income.

I don't live in London so not too sure on how long the wait is down there, but my local court currently has a 4 week waiting list.

London high court has a 'drop in' service for bankruptcy. You fill your forms in, get your fees together and take them to the high court, no appointment needed. A few people on here have gone BR there and hopefully will come along to give you details of the process.
However the OR will need to be able to contact you following your bankruptcy, so you will need to provide an address and telephone number on which they can reach you.0 -

Would the OR accept overseas contact details or would I need to come back to the UK ? Should I take any paperwork or bills, statements with me to the court in addition to the forms?
I contacted one of the companies that deals with overseas bankruptcy and they said that 2 weeks before I leave is not enough and I would need to start the process from overseas - not sure how much of that is true?

If your local court operates a drop in centre you should be fine, I was declared b/r in April at my local courts drop in centre and had my o/r interview the very next day. They sent me some forms about a week later and I've only heard from them once or twice since......as long as you can provide them with some valid contact details and a list of your income and expenditure it doesn't matter where in the world you are0

I have been advised to empty my bank account before filing for BR as my bank would freeze the account, would this include emptying my overdraft (i m already overdrawn)?
A little background info: I "live" off my overdraft, normally once my wages go in every month it pays off my overdraft and a little extra, so i end up having to rely on my overdraft.
Also (maybe a silly question) with regards to my SOA as I no longer have job income would be 0 but for my outgoings do I include my current outgoings or my outgoings after I go abroad in a couple weeks time? I have already paid most of this month's bills if that makes a difference.0 -
