    i am in a similar position myself
    off with a recurring eye problem
    nothing i can do about it,tried to work through it last week and by Saturday i couldnt see properly and was massivly photosensitive
    i am teetering on hitting stage 3 which is 99% sacked with RM

    Is anything that can be done legally? Not sure how far my wifes employer (nhs trust) is going to push this. Could just be scare tactics at the moment..

    No, legally they are entitled to dismiss if she is unable to fulfil the terms of her contract ie be at work.

    Best bet to get hold of a copy of their absence management policy and ensure they are following it to the letter and making no procedural errors.
