Monument Sold CC Debt to Lowells

My OH received letter from Lowells telling him that they had bought debt from Monument. Only thing is he sent Monument a SAR request at the start of last month and it has been received, checked Royal Mail Track n Trace, but they have not cashed the cheque. Question is can they sell the debt when he has asked for a SAR?? and also why did they not cash cheque??? Thanks

  • Maybe they sold the debt on before they received your request? My Monument debt was sold on to Lowells, despite the fact that Monument sent me a complete shocker of a CCA, but when Lowells first contacted me to say they had bought the debt, they told me I was already 2 months in arrears as I'd been paying Monument Compucredit via CCCS.

    On the plus side, Lowells have just offered me an 80% discount on a 4k debt so will be sending them the necessary letters etc.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)

    The SAR is just a request, the debt isn't disputed or unenforceable, so they can sell it on. But your SAR request should still be satisfied, even if passed onto the new DCA they have 40 days from when you sent the SAR.

    If they try to hassle you, just state that a SAR has been sent and you are awaiting the details before discussing this matter further.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

  • Thanks guys, the SAR request was received 2 weeks before they sold it on. I will write to Lowells and tell them that I have asked for a SAR from Monument and see what they say, an 80% discount would be great. Thanks again :beer:
