Change in NRP circs

My ex husband and I had an assessment through the CSA for years - old rules. His assessment was around £24pw. He was always unreliable with his payments, somtimes I never received them, sometimes late but this carried on for quite a few years until they did a review and his payments shot up to around £92 a week with £3k arrears. Obviously he was pretty upset about this and I agreed to make a private arrangement with him for around £200 a month.

This has been going well on the whole, with the odd late payment but he has recently seperated from his wife and I haven't received anything this month. They have 2 kids.

He isn't replying to any of my messages/calls and I'm guessing he can't come up with the money. If I went back to the CSA would they reopen the case under the old rules or the new rules and what happens to the arrears as they were suspended as we had a private arrangement?

I'd rather sort it out with him privately but if he's not answering his phone, what else can I do...Does anyone have any idea of what he should pay now he has another 2 kids he's seperated from? I can't seem to find the info on the CSA website. He's earning just short of £400pw.

    Im on old rules and they told me that if an old rules case is closed, there needs to be 13 clear weeks before a new case can be opened, and then it would be on new rules.

    Its hard to say what he might have to pay without knowing his income, but if you do then there is a calculator thingy on the csa website that gives you a rough idea under new rules.
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    OOps , just noticed you said he earns about £400. Try the calculator on the CSA website. Should give a rough guide.

  • It is no excuse but maybe he is going through the mill at the moment with his divorce?
    Maybe write him a letter advising that you would like to continue it privately but unless he makes contact with you by x date then you will be contacting the csa.
    Worth bearing in mind that the money would be split between you and his new ex though via the csa if you both set up cases. Also the case would be on the new rules, not sure what happens with the suspended amount though.

    It depends on how long the agreement has been going on - if the case was closed over 13 weeks ago you will be assessed under the new rules and if he is no longer living with his ex his assessment will be in the region of £60 per week. However, if the other ex puts in a claim, he will have to pay 25% ie £100 per week, of which you will get 1/3 and she 2/3 so you will get about £33 per week.

    Yes, agreement has been going on for a couple of years now so well over the 13 weeks. Sounds like i'd be slightly worse off then if it was calculated under the new rules. Still £33 per week is better than receiving nothing. I'll see if he replies over the next few days.
