Urgent: Buying Car with Outstanding Unpaid HP Finance

Hi,
I paid deposit to a car garage for a used car last week. I was planning to pick up the car tomorrow. I checked the HPI report from RAC just now and it is showing
VRM Currently showing as outstanding finance.
I am not sure about whether to continue with the purchase. Just wondering what are my rights in this circumstance if I ask the seller to refund my deposit as he is not the legal owner of the car. What should I do if the seller refuse to refund my deposit?

How do you know that he isn't already aware of it and has paid it off already? Dealers take in cars all the time that have outstanding finance, maybe as part-exchanges, and arrange to settle the finance as part of the deal.
When this happens it can take some time for the interest to be removed from HPI.

Insist on receiving a letter stating the finance is settled prior to completing the deal or pay the balance of the purchase price by dividing it between the finance company and the dealer so you know the car comes with free title.I have a cunning plan!
