Its not my loan

I have received a letter off a debt collection company called 1st credit.

The letter states they have bought my debt of £600 for an unpaid loan, and they want it repaid immediately. I have never applied for a loan

I called 1st credit and spoke to an incredibly rude person, who informed me that this was relating to a loan of £500, which had been applied for via the internet, and was paid into a Barclays Bank Account. I told this person that I have never applied for a loan and I do not have a Barclays Bank account, but he was not prepared to listen and threatened me with a CCJ.

Since then I have received 3 letters from 1st credit saying court action will be taken.

I sent 1st credit the letter off this web site, asking for a copy of the credit agreement. This letter was sent on 16/01/09. I reveived the credit agreement contract on 5/10/09 (10 months after I sent the original letter). The agreement was in my name, but had a previous address and incorrect telephone numbers. The agreement was not signed because it stated by clicking agree (on the computer) this would act as a electronic signature.

Could anyone help me with what to do next. I have never applied for, or received this loan. Should I go to the police or a solicitor?

    It sounds like you've possibly been a victim of identity theft. Does the loan agreement sy the date the loan was taken out? Can you prove, maybe through council tax bills/electoral roll registration that you'd moved prior to this date?

    Sorry not to be more helpful, but I'd be tempted to get in touch with your local police. I'd also do a reverse look up on the phone number, to see if you can find out who it belongs to.

    You have been a victim of identity theft from the sounds of it and are therefore not liable for the debt. You do need to get a crime reference number from the police and give this to 1st credit. If they continue to threaten you after that then report them to the police for harrassment.

    The onus is then on them to investigate the fraud and find out who the mystery barclays customer was who defrauded them.

    I have been to the police station today, but they said they could not help me with this and referred me to citizen advice.

    The loan was taken out in April 2008, I had moved out of the property in July 2007. I can prove this will electrol roll/council tax etc.

    What should I do next ??

    CAB then? Then back to the police.

    Go back to the police station and tell them to read the Fraud Act 2006. Then ask them for your crime number.
