More MBNA Intimidation/Scare Tactics!!

MBNA!! They are such a bunch of horrible, horrible people. I posted here a while back about one of their people pestering our neighbours by phone and getting them to drop notes through our door, telling us to contact MBNA. We fully accept we are responsible for our debts and are doing our best to put the situation right via a DMP with the CCCS. We maintain constant contact with MBNA and say the same thing over and over and of course, they keep phoning cause we are not saying what they want to hear. Today was another episode in their campaign. They have written to my hubby (who's name the debt with them is in) saying that they know he has joint freehold on this property (our house) and sent a print out of the land registry document with his name highlighted. They then go on to say he must pay them to prevent any action against the address. I know there is not alot they can do, but their whole scare tactics thing disgusts me.

Woah!! What are they chasing you for? Is it a loan (secured or un?) or a card? Surely they cannot do that!!
I have a loan with them and I've never found them to be very helpful. Will just have to make sure I don't miss any payments!Was debt free... then went travelling!0 -

I may be wrong, but if you are working to resolve the situation, have been in constant contact with them and are going via CCCS, I would feel this is unfair harrassment and is surely not allowed. Have you mentioned it to CCCS? If you are not doing so already all correspondance and phone calls to them I would log dates times and whom you spoke to. This does sound very unfair.0

You are aware that by discussing you with your neighbours they have breached the Data Protection Act? Have you thought about contacting the FSA?£4000 challenge

Thanks everyone. This screams of harrasment now from them! Although I have copies of all correspondance that has been sent, it think I should now log all calls too.
With every call we take, we are upfront and honest, but they are push, push, push for more constantly. The debt we have with them is an unsecured loan for 19K which we paid religiously for 3 years till things got on top of us and we approached the CCCS.Trying sooo hard to save :A0 -
If it's unsecured then they cannot take any of your property. They can't take action against the address either. At the worst they can issue a CCJ. Ring them and explain that you are well aware of your rights, you believe that in discussing your account with your neighbours they have breached data protection, request records of all notes placed on your account and visit https://www.fsa.gov.uk for information about what can and cannot be done. Make them aware that you are not scared of them and advise them that you have made them an offer through CCCS and it is up to them to accept the offer if they wish further payment from you.£4000 challenge

Furthermore remember the person you speak to on the phone is just that - a person. If they sound threatening ask to speak to their superior, don't let them feel like they are intimidating you. You are a human being regardless of your financial status and all they care about will be meeting their targets. And why not make them aware that you know this? I've work in a financial institution and I know what collections are like - beat them at their own game!£4000 challenge

Definately report to the FSO they have breached DPA and also have no right to threaten you in that way. Send a copy of this correspondence back to them with a copy of your letter to the FSO stating that you request an investigation into the integretary of a company that is breaking the DPA and threatening you for money you can't pay without following the correct proceedures when you are doing everything you can with the help of CCCS to sort this out without having to declare bankrupsty.
If possible get hold of something to record all calls from your end. When they call politly advise them that for your and their protection all calls to this number are recorded, a lot of the time they will just hang up after this.Current Mortgage - £156,633:eek:Expecting baby no. one on 27th Oct 20100
