Advice plz? Company car taken off whilst on sick leave?

Will this be applicable if he is on Statutory Sick Pay? He is only getting this at the moment? I presume he wont be paying any tax? Should he notify the tax office anyway? Should his employer do that? - Sorry to ask so many questions, no idea where else I could get this sort of info.
Usually, if he has the car as a benefit and is paying tax; then they shouldn't take the car back. If he is 'using' the car [ie it is unofficial use and a pool car rather than 'his'] then he might not be paying tax on it anyway.
The tax on a company car can be quite hefty; so although he is only getting SSP; it will be calculated over the year; so his code will need changing for the period that he doesn't have the car; if indeed it is being declared.
He really really needs to check the terms and conditions and work out whether it is his company car, in which case it should not be taken away...but if it is and he doesn't want to fight this decision; at least make sure the tax office is aware of this.
Also, have they done this with anyone else in the company? Seems a tad unfair if not.0 -
if he is taking the pool car home every night, he should be paying tax on it as the IR still see it as a benefit.Debt free 4th April 2007.

He does pay more tax because of the car. I am sure it is part of his renumeration package, it states basic salary + company car + commission. I don't think we will fight it though but i will make sure he contacts the tax office.0

I have worked for several companies with cars and this is common practice if you go on sick for more than a few weeks. I have know there a clause written in saying they can as its for buisness use they can have it back. Just tell hmrc that the was not available between the dates he doesnt have access so his tax is correct.0

Not relevant to the question, but did not want to read and run.
I can not comment on the car situation, but just wanted to comment on the medical condition. One of my business partner's sons contracted Hodgkinsons last year. Although the treatment was pretty harrowing, and it was not pleasant for the son, or indeed the family, he has now made a complete recovery.
To be going through these issues with a clearly uncaring employer is not good, and I hope that things will work out for the best in all respects.Don't lie, thieve, cheat or steal. The Government do not like the competition.
