1st credit & debt nearly 6 years old

Hi All

Sorry another thread i had a debt with bank account in 2001,

I defaulted £20,000 1st credit contacted me and i started a payment plan of £50 per month about 6 years ago I stopped paying

I was in council house and not heard a thing for nearly 6 years i have recenly moved bought a shared ownership house and within days 1st credit contacted me

I have checked credit file and its on my file debt 2001 and defaulted jan 2004 i am hoping i stopped payment before this date

I think i may of stopped paying prior to default which would be oct / nov 2003 which 6 years is now

Do i hide till jan when defaulted or do you think they would of defaulted me after missed payments

i am getting loads of letters now and phone calls i have still not made contact

I feel i am so close to this debt or if i make contact and make an offer my father is willing to lend me £2k-£3k so i do not lose my house

Any help is apreciated

    What was the debt for? Loan, creditcard, overdraft?

    You may need to send a subject access request to the original creditor, but be careful with this. You need to do it in such a way that you don't acknowledge the debt.

    i think the debt was for credit card and bank overdrafts i did start to pay but when i met my new partner he did not want me to pay old debts from previous relationship

    i stopped paying i am sure 6 years or very nearly 6 years ago they have not chased me till i bought this house

    it is only a 25% share with my husband and 100% mortgage so there is no money in the house

    Okay, first are you in England? If so then it is 6 years, in Scotland it's 5.

    A CCA request could be sent for the cards, but not the overdrafts. The CCA request letter states that you do not acknowledge any debt to the company so this will not constitute a written acknowledgement. If they are lumping all the debt in together they may reply with statements for the overdrafts too, but not too likely.

    I think your best option if you just need to count the clock down a little is, if they start to pursue you and threaten court action, send the 'prove it' letter. This states that you do not acknowledge any debt to them and require that they provide proof that a debt is owed. Hopefully they will send a statement that shows the debt to be statute barred.
