Council Tax and students?

My daughter has just received a council tax bill for £220 for 6 weeks from July to mid August. She graduated from university in July and started a post grad course at the same university mid-august but the council say she has to pay for the weeks she wasn't 'officially a student' although she had been accepted for the course in February. She is a tenant in the flat and all the other tenants are students (as is the owner).

Does this sound right?

She wasn't actually living there the whole time but had signed the contract on 1st July.
She was only working for a few hours over that 6 week period but hadn't applied for benefits.

Any one with any advice??

    A person can only be disregarded whilst they are full time students. Once they cease being full time students then council tax is payable, the fact she had a place to start confirmed from Feb does not make a difference as she was officially a student on the course until mid August.

    If the owner/landlord is resident in the property then , regardless of the fact they are a student, then the owner/landlord is actually liable for the council tax charge generated by your daughter.

    If there was only 1 non-student in the property for the period then there should be a 25% discount awarded.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
