What to do next

Hi, had some advice from CCCS to declare myself bankrupt recently but just wanted a few thngs clarified if possible. I am recently seperated living in a rented flat with no real assets (car valued at 500 approx) with a disposable income after all expenses of £54 according to the soa compiled with cccs. I owe over 80k to various unsecured sources and have been paying them an agreed sum each month to keep them at bay. I was advised to stop paying them to try to save the £500 needed to go bankrupt but they are now threatening court action as a result of my nonpayment.
If they do carry out the threat can I
Still go bankrupt on these debts
How close to them actually carrying out the threat am I
Will they need an soa from me before they make a decision
Do they need to provide evidence of the debt owed eg signed agreement and am i entitled to see this evidence before court proceedings are issued
Any advice would be gratefully received

    How long will it take you to save up the br fee? Usually it will take months for any action to happen, if you are on certain benefits you can apply to have the fee waivered, have a look on the website.

    I would probably try the bankruptcy board here : http://forums.moneysavingexpert.com/forumdisplay.html?f=136 to be honest. They will probably be the best place to answer your questions as they have lots of people that have been through or are going through it or thinking or doing it.

    At least they're trying to "get out of it"? Yes, you're right, he/she should be applauded for borrowing £80,000 then bravely making it disappear with the bankruptcy magic wand.*rolls eyes*

    As it happens I was asking for further info to see if we could help - i.e. if it related to property etc which can sometimes be treated differently, or if it related to the ex.

    ferox666 it does no good to kick people when they are down by making sarcastic comments. Many people who visit the debt forums are very unhappy and some suicidal. A cousin of mine committed suicide by jumping off a bridge because of debts 20 years ago leaving a wife and two children devastated. You also assume from the tone of your comments that the debt was perhaps caused by the person spending £80,000 on perhaps luxury yachts and gold plated cars which it may have been but then again perhaps the debt has occurred due through long term illness of the person or redundancy followed by long term unemployment even with the best efforts to find work. Comments like yours can only serve to make the person more ashamed of themselves than they perhaps already are.
