Do i have to pay ? Strange situation.

I bought a motorbike from a dealer in may. I purchased the bike on finance, i went through all the details that go along with this to buy the bike on finance. Anyway, i was told to expect a letter in a week or two with my schedule of payments. No letter was delivered and no payments were taken, i just thought it would be sent eventually, it wasn't.

The motorbike shop/dealer contacted me last week explaining that the finance deal was not completed (papers not sent off or something) and that i would have to come back in to sign a new agreement. I told them i would come in when i get a chance, but as i said that was last week so some advice is needed to sort this out.

Is there any chance that i will not have to pay for the bike as i did all they asked of me in the first place ? It is their mistake and the guy on the phone sounded very desperate and nervous when he contacted me over this, which also had me thinking it could be because he's worried there's nothing he/they can do.

Anyone who is clued up this sort of thing or knows of anywhere i could get some sound advice would be very much appreciated. Thanks.

  • Maybe he lost the agreement before sending to the finance company and has no copies and needs you to sign it again.

    I doubt you can get away with a free bike though, you are not that lucky haha

    Can you ring and just ask what the problem actually is?
  • I think it could be worth a shot, you never know lol. He told me because the original agreement was so long ago that he needs me to sign a new agreement, it was in May, so that's what five months ago. He sounded very nervous on the phone also.

    You have the bike , so why not just be a good little boy/girl and pay for it.Then once you have a decent credit score if your good then you can borrow some more money for a car or house.......:rolleyes:

    What if they have lost the agreement? What if the shop guy loses his job because you want to steal the bike?

    They could always take you to court as it hasnt been paid for and attach a CCJ against your file on judgement which as you have the bike any judge will make you pay.

    Exactly the same thing happened to me 6 years ago with a new car purchase (35% down and the balance at 0% for 3 years), although we were only 2 months in...not 5 months.

    Because my dealer was 30 miles away I asked them to post me a new agreement. I then checked it was the same as my copy of the one I'd signed in the showroom and signed and returned it...and yes, I even paid for the stamp.

    Why don't you do the same?

    As far as I can tell without a signed credit agreement you do not owe them anything, its not theft as the bike has ben signed over to you so don't worry about that.

    Its an error in your favour, make the most of it

    To be honest if you !!!! up that bad and cost your employer 1000s, you deserve to lose your job.

    how could they even get to court / ccj, without a signed contract?

    very sirprised OP got goodds to take away, before loan confirmed.

    dealer's loss, though i guess that means ownership isnt provable, either.. when it comesto selling on?

    You were happy to buy the bike and make the payments at the time, why don`t you just sign the agreement again? pay what you owe or would you prefer to make a killing at some other working guy`s expense, maybe even costing him his job.
