Dca trying to collect statute barred debt is putting searches on credit file

Hi All

Got my friends credit file and found that the debt is statute barred (ie no longer showing). Sent the SB letter and the DCA have now closed the file. :T:T

However also noticed on the report that the DCA has put two searches on the file after the statute barred date..(and before they closed the file)......one two years ago and one this year.

Are they allowed to do this? What are the implications for my friend? Is there anything my friend can do to get these removed?

    As far as I remember, debt collection searches are classed as an "unrecorded enquiry".

    In other words, you can see that they took place because it is your report. But any lender searching your report when you apply for credit doesn't see them. So shouldn't have any effect.

    Double check that with the CRAs though, as I can't find my ref on that at the moment....

    Yup, i remember reading this on one of the CRA's websites.

    There are 2 types of search for your credit file - hard searches which require your permission and are seen by other creditors, which are the result of a request for credit; and soft searches which may be to check your identity or address details. Even searches you have made on your file will be here - these are only seen by you and are not full credit searches.

    If in doubt they should check with the CRA as Fermi says.
