Debts of my deceased Father-In-Law

My FIL passed away back in June, and you lovely people on DFW helped with a question I had, as CC companies were being a bit forceful (shall we say) about how his outstanding debts were going to be settled.

I'm afraid I can't find that thread and I have a further question if I may????

What would happen if no payments were made in connection with any unsecured (mostly credit card) debts in relation to his estate? All debts were in his sole name and no-one is financially linked to him in any way.

He didn't own property and had few posessions with little value, and no savings.

What obligations are the executors of his estate under, in relation to these debts??

Hope someone can advise.

Many thanks
L

Only to pay these debts out of any money that might be in your FIL's estate.

If no money can be realised from the estate, then the executors are under no obligation to pay them off. The companies concerned would be forced to write off the debts.

  • my mum died last October and she owed some money on a catalogue, but the priority out of her savings (very small and she lived in sheltered accomodation) were her funeral first and foremost, although her savings didnt cover this. Everything else was written off, the creditors will likely say we would like you to pay, but you are under no obligation at all
