Ideas and Support needed to help clear debts.....

Hi Guys,

I'm having a bit of a "sort my life out Friday"! and have decided, after many years of ignoring things and hoping they will go away - to sit down and work out my debts and a plan of action.

Problem I have is, I have recently moved house, haven't told the companies who were chasing me, that I have moved, and have lost a box of paperwork containing all the letters from creditors....now I don't know how to go about finding out who I owe money too.

I went to the 3 credit reference agencies and got copies of all my reports, however these aren't showing everything I owe - I know there are some missing. In total I think I owe approx £10k, slightly over.

I have sat down and worked out my money coming in, and money going out, and I should have enough to pay the debts, yet somehow I don't...so thats where I need help. Maybe it would help if I filled in a SOA for you too see?

My other question was should I try and speak with the companies directly (once I have found out who they are) or should I use CCCS? I tried to go through PayPlan once before, but they said they couldn't help as I didn't have the right kind of debts?! Surely all debts are debts.....

Anyway, if you can help, I'd appreciate it, as I can't keep ignoring these, and the companies will obviously find me eventually, even if it takes a few months, so Id rather get to them first :)

    Well done on taking the big step in getting the debts sorted out, re checking what you owe, u've done the credit files, not sure what else to suggest on that front.

    Your best bet is do a Statement of Affairs, and it will give you a rough idea of where the money is going.

    yr section for credit cards if you know the aprs that will help.

    Have you had your mail redirected from your old address? If so then your creditors reminders will soon find you. They, however, will not know that you have moved.

    Meanwhile, put up an SOA with your best estimates of the outstanding amounts and let us take a look.
  • mum2one - thank you, I will start with a SOA and see what you can all suggest - do you have a template or a link for it I can use?

    LandyAndy - Yes, I have mail redirection set up for 6 months, so that should give them time to contact me again surely? Although won't I need to give them my new address when I speak/write to them?

    re - mail redirection, yep ur have to give them your address, but you can withhold your telephone number, if your on landline ask to be ex-directory, and also that your number is blocked, stop anyone doing 1471 and getting your number.

    Its usually advised to not speak to them on the phone and only contact them by letter, that way you have a proper record of everything you and they have done. If you speak to them on the phone they are more likely to bully you and more likely to tell outright lies as to your rights and theirs.

    You say these people were chasing you - I assume this means you haven't been making payments? Are there any you haven't paid for 6years? (5years if you are in Scotland?)

    If you haven't paid towards a debt or acknowledged it in writing for 6years then the debt will be statute barred (which means you don't need to repay any money).

    I haven't been making payments towards them no, I wish I had have been, then at least they wouldn't be so high.I believe there are some which haven't had payments made in that time yes...

    My understanding of statute barred isn't that great, but I thought it could only be applied if the company hadn't chased it for that time also? I know that whilst I may not have paid or acknowledged them, they have been chasing me....can this still be applied?

    No its you that has to acknowledge the debt so them chasing you does not count - here is a fact sheet with lots of info on (this is the England/ Wales version)

    The key thing will be working out when you made the last payment (btw if they tell you the default date is the date to work from they are lying, its the date of last payment or letter written by you, the default often happens months later).

    If and when they find you and if you know its 6years then you can send off the SB letter shown in the above thread.
