Not paid debts for over a year????????

Can anyone advise.

I stopped paying all my CC's and loans in June 08 when i got pregnant. I owed then about £33,000 worth all together. Since then i haven't paid any of them at all, ignored calls and letters. I spoke to Consumer Credit Counselling Service and i was going to go bankrupt but haven't done this yet. I have got lots of letters from different debt collecting agencies about then wanting me to pay the money to them ect and then saying they would send people round to my house ect. This has never happened to my knowledge. They have also said many times that this is my last chance before sending me for a CCJ. Have not recieved anything like that either.

So im curious, How long will they keep doing this? Why havent they actually sent anyone round when they said they had, and What happens if i just keep ignoring them? its been about 15 months and nothing other than letters and calls so far...

  • The creditors will keep sending letters for years, soon the debt will be sold or passed on and so the cycle continues.

    They may have sent people round but they don't always leave cards.

    If you keep ignoring them eventually they will take you to court for a CCJ or maybe you will get to 6 years and then the debt might be statute barred so they can't take you to court but they could still keep pursuing you.

    If you went bankrupt then you could wipe out all the debts and start afresh, no letters or hassle which must be a positive when you have a child.

    Do you own a house?

    Do you have a job which may be affected?

    How would you afford to pay for the bankruptcy?

  • I dont own my home its housing association, im working for the NHS at the moent while im at college the other days studying to be a mental health nurse. I would have to save up the money to be able to go bankrupt which is one reason why i havent yet. when you have a baby other things end up taking priority..

    2 of the debts i owed one was with abby cc at £12,000ish and the other was an egg loan of about £9,000. The rest was smaller amounts. I had been paying them all for years and never getting anywhere as i was only ever able to pay the minimum, it was getting ridiculous. in the end i decided to stop paying, i was throwing my money away by never being able to pay much anyway.

    So from what i can gather they dont always send off for CCJ's? because i really thought by now i would have got one if anything, im just surprised ive only had letters and calls..
  • I totally understand about kids and everything associated with them, mine are older now but still I have no time!!!!

    Some companies do not apply for CCJ's, the thing is they have to be able to get something back from you because of the cost so if you don't own a house or have a high income it's not worth it.

    The main companies who go for CCJ's are store cards and catalogues.

    Sounds like they were the ones throwing the money away!

    I haven't paid for over a year either and haven't heard anything. Before that I was making token payments of £1 a month for a couple of years. I'm starting to save up so that when they get in touch I can offer full and final settlements, at the moment I don't know who owns my debts.

    These debts won't just go away

    Have you thought about maybe setting up a DMP and letting them do all the hard work when it comes to getting interest frozen and negotiating repayment plans?

    The fact you're a student means they could easily negotiate bare mimimun repayments
    At least until you're qualified anyway
