16k mortgage exit fee

I was charged an exit fee of 16k (which i knew about when i took the mortgage) however i have now proved that i was missold the mortgage in the first place, I have just been given back the brokers fee for the mortgage set up, Do anyone think i have a chance now that i have at long last proved that the mortgage was missold, ?

Being mis-sold in the first place in one area does not let you off the hook in another area. If the advice that was considered bad is linked to the ERC then you have a case. There seem to be two issues
1) The mortgage was 'mis sold' - we don't yet know why
2) The exit fee - the OP seems to imply they weren't told about this over the phone. Surely though this would have been in the KFI and offer letter.
Really more detail is needed - e.g. did the broker not state on the phone there were ERCs?0 -
The broker delt with the complaint, it seems that if i had re-paid 200k back and left the 36 as a mortgage i would have not had to pay this large fine, I had asked if i could do this and was told i could not, now they have agreed in writing and are going to refund my brokers fee in full due to poor advice on thier part, so thats what got me into thinking could i get a refund on this fine,0
