Barclaycard/Mercers - Help Needed!

Hi,

I'm currently at stalemate with Barclaycard over lack of a CCA. I've been corresponding with them since Nov 2008 and have recently only ceased payment to prompt them into providing one. I've sent the usual letters that I've found in the forums but all BC say is that they do not have to send a copy to me. The account is 3 months in arrears. I've now had letters from Mercers to which I've sent a response saying that the account is in dispute. I've received a letter from them today saying that they have instructed power2contact(??) to send a contact manager to see me. I've called Mercers and reiterated that the account is in dispute and they can send who they like out. What can I do next?

    Have you sent a SAR to Barclaycard t osee what the "real" original copy looks like and if it has all the terms on it?

    I would write to mercers stating that the debt is in dispute and should not have been passed to them - there is a letter on the template thread for this.
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

  • I've had a similar experience with no CCA being provided only generic terms & conditions and Mercers getting ScotCall to contact me. This is a bit different a Scottish company threatening me with English (& Welsh) law!
    I've made a SAR application so await with interest to see what they produce.

    Haven't sent a SAR yet but have told mercers twice that the debt is in dispute.

    Did you put this in writing?
    It's sometimes surprising what DCA's will ignore if you can't prove it was said.

    If you have put it in writing and they are ignoring this then you could threaten to report them for breach of the OFT debt collection guidelines.

    Otherwise send this in writing by recorded delivery (and don't sign the letter, just print your name)
