early discharge questionnaire

Hi
Yesterday I received an early discharge questionnaire from my OR.
I was declared BR in early June.
I rang the OR over another query and whilst on the phone I asked what the chances of me receiving ED were and they said that as I had received the questionnaire I would definately get ED unless my creditors objected and that rarely happens.
The OR said I would be discharged before the year is out.
Is that correct? It seems a bit too good to be true.
I only earn a small wage though compared to giant debts and do not have an ipa.
What exactly will this change in my life? I can't see that much being different tbh.

He can't guarantee ED, it will depend how busy the office is, it might get shelved at any point if they get very busy. ED's are way down on the list of priorities for them. At the moment we have 2 or three posters who sent the forms back and are still waiting.
If you do get ED then all it means is you are no longer bound by the restrictions of BR and you no longer have to inform the OR if you get a pay rise or win the lottery.

The OR will firstly send 'report to creditors' this is normally done within 8 weeks of the making of the bankruptcy order (your appearance at court etc). It's the initial report from the OR that tells creditors (amongst other things) the reasons for the insolvency and the likelihood of creditors receiving any payments from the estate.
The OR's office must then wait 3 months before they can consider starting the ED process if they feel it is appropriate.
For the ED, you have 14+7 days to return the IPOQ (I&E questionnaire..this is sent to you from the OR office if your considered for ED) after which the OR can write to the creditors to say that they will be applying for the ED and request any objections.
The OR's office must then wait 28 +7 days to allow creditors to reply. Then if no valid objections have been received, the ED notice can be submitted to the court.
So the quickest the ED could happen (in theory) is 56-57 days after the you get the ED/IPOQ letter.
it often takes longer and can even be shelved at any stage if the office is too busy with new cases as ED is NEVER a guarantee...BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -

The OR said I would be discharged before the year is out. They cant guarantee that besides it's probably an examiner you spoke to NOT the or and they cant make those guarantees as others have said

I only earn a small wage though compared to giant debts and do not have an ipa. ED can be given for many reasons so not really an issue how much you owed/earn could be simple as the OR wants to clear a backlog of case notes..
What exactly will this change in my life? I can't see that much being different tbh to be honest? wont make any changes except your no longer required to report to your OR for anything.

Hi all i had my ED letter in the post on the 17th August (went BR march 2nd) i sent the form back as i am currently seeking work after finnishing college so dont have an IPA or any income at present as my partner pays all the bills etc. I had another letter asking to conform this a few weeks ago, i rang up and they said that my ED was with the admin person who deals with the ED letters and it was just a case of waiting. It also said on the bottom of the letter "Please do not contact the office regarding early disacharge as this could cause delays" I am going to be good and do as i am told for once LOL
. sadly its just a case of waiting and checking the insolvency register every now and again

I thought that it was a waiting game, but when they said i would be discharged by the end of the year I got excited! guess i'll just have to expect to wait but hope not to!!Lead me not into temptation, I can find the way myself.
