Advice re a payroll error 3 years ago...

Hi all,

Would really appreciate some advice on the following:

Back in July 2006 our work changed payroll systems. Apparantly due to this, an advance was paid (£200-£400 average). Staff were meant to have been advised about this and the advance deducted when you leave employment with the company.

Staff have been leaving and the amounts being deducted from their final payslip. Obviously this has resulted in several very angry conversations so the company is now informing everyone and wanting them to sign a document to say that the deduction will come out of their final pay slip - or a monthly deduction.

Can anyone advise where we would stand legally? We are in Northern Ireland, baring in mind staff were not told about the advance (other than printed on some payslips), its over 3 years ago and no authorisation slips have been signed.

Any advice welcome!

Usually in cases like this, the employer would request payment back on a monthly basis, so you don't miss a huge chunk at once. You could offer this!!

As for them doing anything wrong legally, no.
