Halifax

hi recevied a letter from Intelligent Finance about my CC, they have already defaulted me for not bringing my account up to date. they are in the process of passing it to a DCA?? which one i don,t know, i rang them on Saturday as the letter states they will issue more default notices against my account??? i thought they could only issue one default ??? is this right.

update the debt has been passed to Albion ??? anyone heard of them, they are apart of the halifax.

    sorry i dont know the answer about default notices, I just know Albion is in inhouse as was passed to them while they pretended they did not have any of my letters about my DMP with CCCS
  • hi and thanks for that, i am on a DMP with Pay plan and my other remaining three creditors have accepted my DMP, just these NOOBS are acting the goat, Halifax and Albion, Halifax say they cannot locate my account and have not received my SOA but it has been sent twice via e-mail and once via fax, anyone else having trouble with the Hellifax.

    when i spoke to the girl on Saturday i asked her who Albion where and she genuinely did not know.:eek: <<and it was Albion i was ringing.......

    They can only record a default with the credit reference agencies once, which is what really matters.

    They may not have actually taken that step so far. Have you checked your reports?

  • hi yes they have already defaulted me on the 13th July for not bringing the account up to date. but in a letter received on Saturday they say they will issue further details of the default notices (what does that mean) which will ruin my credit rating.

  • halifax are a joke, when they were on the phone to me they were nice as pie and said would accept my DMP but surprise surprise they never received my letters. CCCS says they pull this stunt all the time. I was charged £10 every time they called me and £30 everytime they send a letter. They have also told me though they now have the arrangement set up they will still be calling me every month. CCCS has advised me to send a letter asking them to remove me telephone number so good luck with them. My DMP started in July and I have had about 3 default letters from them

    oh and I also received a letter from them saying they had no record of my account yet when CCCS sent second letter it was processed within a week. They are pulling a fast one.

    Sorry just wanted to add that they never received letters about my loan and It was a bank account that I had held for over 10 years and had a overdraft with that they said they held no record of my account

    When they first send you a "default notice", that does not mean that they have recorded a default with the credit reference agencies.

    A default notice basically warns you that you have not kept to your contractual payments and should give you 14 days (I think) to correct this situation. If you bring your payments up to date in time then the account would go back to normal, not be formally defaulted, and no default would be recorded with the CRAs.

    So it looks like you have had a "warning" default notice, and they are now saying that if you don't get your payments up to date as per the original agreement then they will formally default the account and put it on your credit files.

    To be honest, if you are on a DMP where you are paying less than the contractual minimum then this is bound to happen really. The company is entitled to default you and it's more or less ineveitable that they will.

    Deafults stay on your files for 6 years from the date they first go on, so in some ways if it is ineveitable then sooner is better than later.

  • I'm sick of them too.
    I sent them a letter - recorded delivery- over a fortnight ago regarding my overdraft.
    I asked for them to freeze the interest and accept a minimum payment as suggested by PayPlan.
    They have not replied but have now stopped access to my account.
    Fortunately I had taken the advice off here and opened another one and transferred all my direct debits etc.
    I am expecting them to write now and start charging me for the letters.
    This will be a nightmare cos my overdraft was at it's limit.
    I do intend writing to them again in the morning.

  • i have to admit my overdraft is at its limit. They sent me a letter accepting my arrangement but told me they will still charging interest for the next year and then reconsider if payment had not went down (which it will not as the interest charges are higher than my payments). I have send them a letter asking them to re consider but Im not holding my breath.
  • They can't really get blood out of a stone.
    I used to be a project manager on a good salary but now on Incapacity Benefit after being seriously ill.
    I have had to contact all of my creditors and send them a detailed financial breakdown plus proof.
    I am going to get Citizens Advice to help me get through to them because I am worried about their lack of communication.
