Offering settlement to Barclaycard

    It is true that Barclaycard have an 'in-house' debt colelction dept (or it was when I worked for them). These where ordinary members of staff who chased debt and arranged payment methods. They usually wanted an SOA to see where they could get money from you i.e. gym membership, fags, magazine subs, driving lessons etc. These where considered 'luxury' items and they would ask you to scrap them and put the money towards your debt.

    As for monthly statements - as far as i'm aware Barclaycard (along with other cc companies) are obliged to send you a monthly statement details your balance to the address you have provided (have you moved recently?). The only time the do not send statements is when you hae a nil balance.

    I don't think a DCA can come to your door without notifying you in advance that they are dealing with the debt. they usually write to you and give you at least 7 days to contact them.

    Please feel free to correct me if I am wrong.

    Hi thanks for replying, no not moved house, been here 18yrs this year, I know hubby is so worried he is thinking of contacting FirstPlus or Norton finance to pay barclaycard off.....:rolleyes:

    barclays are trying to frighten you into paying them even if you can't afford it.

    they cannot enter your house or take anything until there has been a CCJ that authorises the bailiffs to seize your property.

    sorry if you have already posted your problems, but if not, why not start your own thread and explain fully the situation?

    Please do not go to one of those 'credit expert' lending companies until you have exausted every other possible route. I've never used one and from what I've read on MSE they are seriously not worth it in the long run.

    i would advise (in my non-expert opinion) you to try and make an affordable arrangement with barclaycard. Do not over stretch yourself (in case you ever default). Ensure you make a note of every conversation you have with them (time, date, person you spoke to etc), also make sure you save a copy of every letter/email you send them. If you amke an arrangement with them and stick to it then I don't think they can send and balliffs round or pass the debt onto a DCA. Even if they do - your arrangement is with barclaycard not the DCA. Do not let them put the frighteners on you.

    As for a CCJ, if I remember correctly they have to take you to court to get this. They must notify you of a court date and you have the right to attend this hearing. At this point (if it ever goes this far) then you have the chance to present your case. If the judge can see that you have tried everything in you power to pay the bill or have tried to enter into a suitable arrangement with the company (and they are being stiffy about it) then the judge is more likely to come down on your side rather than the company to whom you owe the money.

    Make the arrangement with Barclaycard first (dont get the DCA involved) and stick to the arrangement. This way they cannot take you to court or attempt to arrange a CCJ.

    thanks for replies, have started to SOA in earlier postings.

    in dec I was working a temp xmas job for 179 a week take home and 150 a week was being paid to credit cards etc, I was fed up with this, so dec 28th I decided new year , new start.

    I contacted all our credit card companies and it was barclaycard who suggested contacting the cccs which hubby and I did , because our budget is 'not sustainable' at the moment not enough to pay basic household bills never mind anything left for creditors, anyway , hubby been off work and just had an operation so at the moment we are living on SSP 70.05 a week , put in a claim for income support but nothing as yet.

    anyway Barclaycard are wanting 52 a month with the promise of not taking it to a debt agency , which I thought we could afford (I actually paid 52 in march)but at the same time all other creditors are getting £10m , so why should Barclaycard be different? So I phoned them up and offered (and have been paying £10m) but they say they can't accept this and the next thing that is going to happen they are sending a debt collector round to the door.

    I've sent Barclayacrd CCCS income/exp paperwork and its been passed onto Mercers who are now passing it onto the debt agency ( i asked for name of DCA but mercers refused)

    i've tried explaining to them till I'm blue in the face, that I can't afford 52 a month and i will pay £10 a month.

    But I've noticed on Experian , it has been put down that no payments have been for the last 4 months against my Barclaycard, is that correct? doesn't the fact that reduced payments have been made, have to be noted? can I contact Experian and correct this?

  • As far as I am aware your credit file would show no payments or late payments if you are on reduced payments because you are not paying the full minimum payment. They should have advised you at the time that a payment plan will show on your credit file.
