  • yes he is paying month to month but is 1300 when he didnt pay for a bit a while back, says due to waiting for housing assocation money
  • I don't think it matters if he declared the £1300 on the forms. If it is a joint tenancy then the non bankruptee would be liable for all arrears and future payments if the bankruptee didn't/doesn't pay.

    I'm not 100% sure of this but think it is the case.

  • Going BR shouldn't affect his benefits.

    But he will have to declare all these to the OR who will basically decide his finances while undischarged.

    Hi,

    What he could do is to ask benefits to pay the LL direct. This way all the backdated money will go to him & any hb he gets now will be paid. This is what LHA do. I get HB but it goes direct to LHA so I never actually see it.

    Ask him to speak to benefits to see if they can arrange it. The LL / agency should be fine as it means they get their money.

    He will still get all his other benefits same as an employed person will still get paid. BR is only where you can't service your debts adn is causing severe financial hardship & there is no other option.

    He'll had to put down all his benefits on his income & outgoings form then the Official Receivers will decided whether he needs to make a payment towards his debts. Most people on beneifts don't get IPA / IPO.

    Have a read through the forums to get a little better understanding.

    Did he petition his own br or did a company br him> Do you know if he received any advice from CAB, National Debtline or CCCS. If not, tell him to give one of them a ring.
